Starting tomorrow, a 30-day admonition period ends for people using hand-held devices in the Bozeman urban district limits.

Since the ordinance went into effect on Jan. 17, 70 drivers have been stopped and warned for violating the ordinance. The Bozeman Patrol Department said in a press release that starting Friday, Feb. 17, officers will establish issuing civil citations to drivers who are stopped for violating the ordinance. The pulverized is $100.

The ordinance states: No person shall use or have in their immediate physical property a hand held electronic communication device while operating a motor means, motorcycle, quadricycle or a bicycle on a public highway, within the city limits of Bozeman.

Per the ordinance, a give out held electronic communications device includes "wireless or cellular phones, Blackberries, capable phones, I-phones, laptop and notebook computers utilizing VOIP (voice over internet minute) technology, navigational systems, and any other mobile communications device that uses epigrammatic-wave analog or digital radio transmissions between the device and a transmitter to permit wireless communications to and from the alcohol of the device". Immediate physical possession means "stirring the hand held electronic communications device or physically holding the manoeuvre in one's hand or up to one's ear". Simply having the electronic communications badge on one's person or in a motor vehicle does not constitute immediate solid possession.
